What is the Clear Cooperation Policy?
Section 1.01 of the Rules and Regulations says, "Within one business day of marketing a property to the public (excluding Commercial and Rentals), the listing broker must submit the listing to the MLS for cooperation with other MLS participants."
Business days exclude Saturdays, Sundays and federal holidays.
What is considered public marketing?
Public Marketing includes, but not limited to:
- flyers displayed in windows
- yard signs
- public facing websites
- email blasts
- multi-brokerage sharing networks
- social media 'teaser' content
What Agents should know to avoid violating Clear Cooperation Policy?
- If your listing is not ready to be shown, but you want to have it on the MLS to accept offers outside of your office, use the Coming Soon Listing Addendum. Also be aware of the rules involved with using the Coming Soon Status.
- Submit a SOMO 101 Form to support@gsbor.com if your seller does not want their property on the MLS, or if it will be longer than 4 days before the listing is submitted.
- If you are withholding a listing from the MLS for any reason or duration, you cannot advertise the listing publicly- including placing a sign in the yard.
- If you, your office, or the seller does any form of public advertising, it MUST be entered into the MLS by the end of the following business day. The 4 day grace window no longer applies in this case.
What should an Agent do if they suspect violations of the Clear Cooperation Policy?
